Agreement to these Terms
These Terms of Use (“Terms”) are an agreement between you and Roadster Now (“Roadster Now,” “we,” “us” or “our”) governing your access to and use of roadster-now.us and our newsletter (together, the “Site”). By using the Site, you agree to these Terms and to our Privacy Policy, Cookie Policy and Disclaimer, which are incorporated by reference. If you do not agree, please do not use the Site.
Changes to these Terms
We may revise these Terms from time to time. The updated version will be posted on this page with a new “Last updated” date and takes effect when posted. Your continued use of the Site after changes are posted means you accept the revised Terms.
Eligibility
You must be at least 13 years old to use the Site. If you are under the age of majority where you live, you may use the Site only with the involvement of a parent or legal guardian.
Informational content only
Everything on the Site — articles, buying checklists, road descriptions, the Roadster Finder and the weather tool — is general information for enthusiasts. It is not mechanical, legal, financial, insurance or safety advice, and it is not a recommendation to buy any particular vehicle. Vehicle specifications, prices, road conditions and regulations change; verify important information with qualified professionals and official sources before acting on it.
You are responsible for your own decisions and for driving safely and lawfully. Never use public roads for racing or speed testing.
Intellectual property
The Site and its original content — including text, page design, the Roadster Now name and logo, original illustrations and code — are owned by Roadster Now or its licensors and are protected by copyright, trademark and other laws.
Photographs on the Site are used under public-domain dedications (CC0) or the Public Domain Mark and are credited on our Photo Credits page. Your rights in those photographs are governed by their original licenses.
We grant you a limited, revocable, non-exclusive, non-transferable license to view the Site for personal, non-commercial purposes. You may share links to the Site and quote brief excerpts with attribution and a link back. Any other use requires our prior written permission.
Acceptable use
When using the Site, you agree not to:
- violate any applicable law or regulation, or infringe the rights of others;
- copy, scrape or harvest content at scale, or access the Site through automated means, except for search engines that comply with our robots.txt file;
- use Site content to develop or train machine-learning or artificial-intelligence models without our prior written consent;
- probe, scan or test the vulnerability of the Site, or interfere with its security or operation;
- upload or transmit viruses, malware or other harmful code;
- impersonate any person or misrepresent your affiliation with anyone; or
- submit false, misleading or abusive information through our forms or email.
Feedback and submissions
If you send us feedback, corrections, ideas or suggestions, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use them for any purpose without compensation to you. Please do not send confidential information.
Third-party links and trademarks
The Site links to websites we don’t control. We are not responsible for their content, accuracy, availability or practices, and a link does not imply endorsement.
Vehicle manufacturer names, model names and other trademarks mentioned on the Site belong to their respective owners and are used only to identify the products being discussed. Roadster Now is not affiliated with, sponsored by or endorsed by any vehicle manufacturer, dealer or road authority.
Disclaimer of warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT ANY INFORMATION ON IT IS ACCURATE, COMPLETE OR CURRENT.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ROADSTER NOW AND ITS OWNERS, CONTRIBUTORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS (US $100). Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.
Indemnification
You agree to indemnify and hold harmless Roadster Now and its owners, contributors and service providers from any claims, losses, liabilities and expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or your misuse of the Site.
Governing law and venue
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Subject to the next section, any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Delaware, and you consent to their personal jurisdiction. Nothing in these Terms limits any rights you have under the consumer-protection laws of your state of residence.
Informal dispute resolution
Before filing a claim, you agree to contact us at [email protected] with a description of the dispute and give us 30 days to try to resolve it informally. We will do the same for you.
Copyright complaints
If you believe material on the Site infringes your copyright, email [email protected] with: identification of the copyrighted work; identification of the material and where it appears on the Site; your contact information; a statement that you have a good-faith belief the use is not authorized; a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature (see 17 U.S.C. § 512(c)(3)).
Suspension and termination
We may suspend or restrict access to the Site, or any part of it, at any time and without notice if we reasonably believe you have violated these Terms. Sections that by their nature should survive — including intellectual property, disclaimers, limitation of liability, indemnification and governing law — will survive.
General terms
These Terms, together with the policies referenced above, are the entire agreement between you and us regarding the Site. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a business transfer. Headings are for convenience only.
